- die PV-Anlage nicht auf oder in der Nähe von einem begünstigten Gebäude i.S.d. § 12 Abs. 3 Nr. 1 S. 1 UStG (Privatwohnung, Wohnungen oder öffentliches oder anderes Gebäude, das für dem Gemeinwohl dienende Tätigkeiten genutzt wird) installieren oder installieren werden bzw. die installierte Bruttoleistung der PV-Anlage laut Marktstammdatenregister mehr als 30 Kilowatt (peak) beträgt oder betragen wird.
